Complaint Demands FIR Against Sonia Gandhi, Rahul Gandhi

A complaint lodged with the Delhi Police on August 16 seeks to register a First Information Report (FIR) against Congress leaders Sonia Gandhi and Rahul Gandhi. This action stems from their alleged disruption during the performance of the National Song “Vande Mataram” at a function held at the AICC headquarters on August 15.

The complaint, filed by advocates Kunal Vinayak and Shubh Sharma, asserts that police should first determine the applicability of the Prevention of Insults to National Honour (Amendment) Bill, 2026. This bill aims to offer penal protection to the National Song similar to that of the National Anthem, with a proposed punishment of up to three years, a fine, or both for intentionally disrupting their rendition.

According to the complaint, Sonia Gandhi allegedly made gestures that suggested she objected to the rendition of “Vande Mataram,” which occurred at Indira Bhawan. This specific incident garnered attention after it was supported by circulated video footage and coverage by various media outlets.

Further claims in the complaint assert that during the performance, Rahul Gandhi reportedly stated, “We are not singing Vande Mataram,” indicating a refusal to participate.

The complainants emphasize the need for a thorough investigation to understand the nature of the acts performed by the Congress leaders during the event. They urge the competent authorities to examine video evidence and assess the intentions behind their behavior.

Lawyers representing the complaint have highlighted the need for clarity on the legal status of the proposed amendment, particularly as it pertains to the incident. They reference the Supreme Court’s 2018 ruling in Shyam Narayan Chouksey v. Union of India, to corroborate the need for a legal framework surrounding acts that may prevent the singing of the National Anthem or National Song.

The primary demand of the complaint is for the registration of an FIR after verifying the legal position concerning the incident. The advocates request a comprehensive investigation into the alleged conduct of Sonia Gandhi and Rahul Gandhi.
